Terms of Use

These Terms of Use (“Terms”) govern access to, browsing of, and use of the website, digital platforms, and services operated by Muktidharma Foundation (“the Foundation”) by any person or entity who accesses or uses this website, including visitors, beneficiaries, donors, volunteers, and partners (“User”). By accessing or using this website in any manner, users acknowledge that they have read, understood, and agreed to be bound by these Terms and all applicable laws in force in India. If a user does not agree with these Terms, they are advised to discontinue use of the website immediately.

 

1. Nature and Purpose of the Website

Muktidharma Foundation is a not-for-profit organisation incorporated under Section 8 of the Companies Act, 2013, established for charitable and public welfare purposes, including promotion of access to justice and legal awareness. The website is operated strictly on a non-commercial basis and is intended to:

  • provide general information about the Foundation and its objectives;

  • promote legal awareness and constitutional rights; and

  • facilitate communication for charitable legal aid activities.

Nothing on this website shall be construed as a solicitation, advertisement, or inducement for legal services, nor shall it be used for commercial gain, in compliance with the Advocates Act, 1961 and the rules of the Bar Council of India.

 

2. No Legal Advice and No Attorney–Client Relationship

All content available on this website is provided solely for informational and educational purposes. Nothing contained herein constitutes legal advice, legal opinion, or professional consultation of any kind. Use of this website, submission of information, or communication with the Foundation does not create an attorney–client relationship between the user and the Foundation, its directors, officers, employees, volunteers, or empanelled legal professionals. Users are advised to seek independent legal advice before acting on any information obtained from this website.

 

3. User Obligations and Acceptable Use

Users agree to use the website in a lawful, responsible, and ethical manner. Users shall not:

6. Data Protection and Privacy (DPDP Act, 2023 Compliant)

The collection, processing, storage, and use of personal data through this website are governed by the Foundation’s Privacy Policy, which forms an integral part of these Terms and must be read in conjunction with them. The Foundation acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023, and processes personal data lawfully, fairly, and transparently for specific and legitimate purposes connected with its charitable objectives.

The Foundation may process personal and sensitive data, including information relating to undertrial prisoners, accused persons, family members, donors, volunteers, and website users. Such data is:

  • collected with consent or lawful authority;

  • used only for stated purposes;

  • protected through reasonable security safeguards;

  • retained only for as long as necessary; and

  • shared strictly on a need-to-know basis or where required by law.

Users, as Data Principals, have the right to:

  • access information about their personal data;

  • request correction or erasure where applicable;

  • withdraw consent, subject to legal limitations; and

  • raise grievances regarding data processing.

7. Grievance Redressal and Grievance Officer

In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, the Foundation has established a grievance redressal mechanism.

Any grievance relating to:

  • website content or functionality;

  • misuse of information;

  • data protection or privacy; or

  • violation of these Terms
    may be submitted in writing or electronically to the Grievance Officer. The Grievance Officer shall acknowledge receipt and endeavour to resolve the grievance within the timelines prescribed under applicable law.

8. Limitation of Liability

To the maximum extent permitted by law, the Foundation shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from the use of, or reliance upon, the website or its contents.

 

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or use of the website shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, India. By accessing this website, the user expressly agrees to such exclusive jurisdiction.
